Jaded Software, LLC ("Jaded Software," "we," "us," or "our") provides custom software development, cloud architecture consulting, and related web applications. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit jadedsoftware.com, sign in with Google, accept an invitation, or use our administrative and client-facing portal features.

Information We Collect

We collect information you provide directly, including your name, email address, company, contact details, inquiry messages, and account invitation information. If you sign in with Google, we receive the account information Google makes available for authentication, such as your email address, name, profile identifier, and basic profile image when provided.

We also collect limited technical information, including IP address, browser type, device information, pages viewed, referral details, timestamps, session activity, and other diagnostics used to operate, secure, and improve our services.

How We Use Information

We use information to authenticate users, process invitations, provide access to authorized applications, respond to inquiries, deliver consulting and development services, secure our systems, troubleshoot issues, monitor usage, comply with legal obligations, and communicate service-related updates.

Google Sign-In

We use Google Sign-In to verify user identity and simplify account access. We use Google account data only for authentication, account identification, access control, and user support. We do not sell Google user data, use it for advertising, or share it with third parties except as needed to provide, secure, or legally operate our services.

Google Drive Integration

Some Jaded Software applications, including WritersBlock, offer an optional Google Drive integration that lets users back up their content to their own Google Drive and restore it later. This integration is opt-in and can be disconnected by the user at any time.

When you connect Google Drive, we request the https://www.googleapis.com/auth/drive.file scope. This is the most restrictive Drive scope: it grants the application access only to (a) files and folders the application itself creates in your Drive, and (b) files or folders you explicitly select through the Google Picker dialog. We do not enumerate, scan, index, or read any other files in your Drive. We additionally request the userinfo.email scope solely to display which Google account is currently connected so you can verify the connection.

We use Google Drive data only to perform the backup, restore, and file-import actions you initiate from within the application. We store an encrypted Google OAuth refresh token on our servers so the application can perform these actions on your behalf without prompting you to sign in again each time; the refresh token is encrypted at rest and is deleted when you disconnect Google Drive.

Jaded Software's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. We do not sell Google user data, use it to serve advertising, transfer it to third parties except as required to provide or improve user-facing features (or as required by law), or use it for any purpose unrelated to the user-facing features described above. We do not allow humans to read Google user data except with your explicit consent, to comply with applicable law, or for security purposes (such as investigating abuse).

You may revoke Google Drive access at any time from your account settings within the application or from your Google Account permissions page at https://myaccount.google.com/permissions.

Cookies And Similar Technologies

We may use cookies, browser storage, authentication tokens, and similar technologies to keep users signed in, maintain session state, remember application preferences, analyze site performance, and protect against misuse.

How We Share Information

We may share information with service providers that help us operate our website, cloud infrastructure, authentication, analytics, email delivery, support, and security systems. We may also disclose information when required by law, to protect rights and safety, to investigate abuse, or in connection with a business transfer.

Data Security

We use administrative, technical, and organizational safeguards intended to protect information against unauthorized access, loss, misuse, or alteration. No system is completely secure, but we work to keep access limited to authorized personnel and service providers with a legitimate need.

Data Retention

We retain information for as long as needed to provide services, maintain business records, meet legal obligations, resolve disputes, enforce agreements, and secure our systems. Invitation, audit, and analytics records may be retained for operational and security purposes.

Your Choices

You may request access, correction, or deletion of personal information by contacting us. Some records may be retained when required for security, legal compliance, billing, dispute resolution, or legitimate business operations.

Children's Privacy

Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.

Changes To This Policy

We may update this Privacy Policy from time to time. The updated version will be posted on this page with a revised effective date.

These Terms of Service ("Terms") govern your access to and use of jadedsoftware.com, the Jaded Software portal, and any related websites, applications, APIs, and services (collectively, the "Services") provided by Jaded Software, LLC ("Jaded Software," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using the Services you represent that you meet these requirements and that any information you provide is accurate and complete.

Accounts And Authorized Access

Some Services require an account, which may be created through Google Sign-In or by accepting an invitation. You are responsible for safeguarding your credentials, for all activity that occurs under your account, and for keeping your contact information current. You must notify us promptly of any unauthorized use or suspected security incident involving your account.

We may suspend or revoke access at any time, with or without notice, if we believe an account is being misused, has been compromised, or violates these Terms or applicable law.

Acceptable Use

You agree that you will not, and will not permit any third party to:

• use the Services in violation of any applicable law, regulation, or third-party right;
• access or attempt to access any account, system, data, or resource you are not authorized to use;
• interfere with, disrupt, degrade, or circumvent the Services or any related security mechanism;
• upload, transmit, or distribute malicious code, harmful content, or unlawful material;
• scrape, harvest, or otherwise collect information from the Services through automated means without our prior written consent;
• reverse engineer, decompile, or attempt to derive source code from the Services, except to the extent permitted by applicable law;
• use the Services to send unsolicited communications, spam, or fraudulent messages; or
• resell, sublicense, or otherwise commercially exploit the Services without our prior written consent.

Professional Services

Custom software development, cloud architecture consulting, integration work, and other professional services performed by Jaded Software are governed by the applicable written agreement, statement of work, master services agreement, or order between you and Jaded Software. To the extent any such agreement conflicts with these Terms, the terms of that agreement will control with respect to the services it covers.

Customer Content

"Customer Content" means data, materials, and information you submit to or generate through the Services. You retain all rights you have in Customer Content. You grant Jaded Software a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and otherwise use Customer Content solely as necessary to provide, secure, maintain, and improve the Services and to comply with applicable law.

You are solely responsible for Customer Content and for ensuring that you have the rights and consents necessary to provide it to us and to permit our use as described in these Terms.

Our Intellectual Property

The Services, including all software, content, designs, and trademarks, are owned by Jaded Software or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. No other rights are granted by implication, estoppel, or otherwise.

Feedback

If you provide suggestions, ideas, or feedback about the Services, you grant Jaded Software a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without restriction or compensation to you.

Fees And Billing

Where the Services include paid features or subscriptions, fees, billing terms, payment methods, renewal behavior, and refund eligibility will be presented at the time of purchase or in the applicable order or agreement. You are responsible for all fees and applicable taxes associated with your account. Late or unpaid amounts may result in suspension or termination of access.

Third-Party Services

The Services may interoperate with, link to, or rely on third-party services (for example, Google Sign-In, hosting providers, payment processors, or analytics tools). We do not control and are not responsible for third-party services, and your use of them is governed by the terms of the applicable third party.

Service Availability And Changes

We work to keep the Services available but do not guarantee uninterrupted, error-free, or completely secure operation. We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

Disclaimer Of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement, to the maximum extent permitted by applicable law.

Limitation Of Liability

To the maximum extent permitted by applicable law, Jaded Software and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the Services. Our total aggregate liability arising out of or related to these Terms or the Services will not exceed the greater of one hundred U.S. dollars (US$100) or the amount you paid Jaded Software for the Services in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You will defend, indemnify, and hold harmless Jaded Software and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your Customer Content, or your breach of these Terms or applicable law.

Termination

You may stop using the Services at any time. We may suspend or terminate your access at any time, with or without notice, including for breach of these Terms, suspected misuse, or to protect the Services or other users. Sections of these Terms that by their nature should survive termination will survive, including those relating to ownership, disclaimers, limitation of liability, indemnification, and governing law.

Governing Law And Disputes

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or related to these Terms or the Services will be the state or federal courts located in Denver, Colorado, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking equitable relief in any court of competent jurisdiction.

Changes To These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Material changes will take effect when posted, and your continued use of the Services after the change constitutes acceptance of the updated Terms.

Miscellaneous

These Terms, together with any applicable order, statement of work, or written agreement, constitute the entire agreement between you and Jaded Software regarding the Services. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
